This Terms of Service ("Agreement") is a legal agreement between you ("User," "you," or "your") and Chamberlin Innovations SASU ("Company," "we," "us," or "our"), doing business as Legacees. This Agreement governs your access to and use of our website located at legacees.com (the "Site") and our memory timeline creation services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree, do not use our Services.

1. Description of Service

Legacees provides a digital platform for creating specialized collaborative memory timelines. Our Services allow users to upload photos, audio, text, and other content ("User Content") to create a compiled digital presentation ("Timeline").

2. Eligibility & Account Security

  • Age: You must be at least 13 years old (or 16 years old if required by local law in the EU, e.g., France/Germany) to use our Services. Minors require parental supervision.
  • Account: You agree to provide accurate information. You are responsible for safeguarding your password and for all activities under your account.

3. Payment & Refund Policy

PLEASE READ CAREFULLY. OUR REFUND POLICY IS STRICT DUE TO THE CUSTOM NATURE OF THE SERVICE.

3.1 Payment

Payment is required upfront to access premium features. Prices are in USD or EUR. Payments are processed via third-party secure payment processors (e.g., Lemon Squeezy). By making a purchase, you also agree to the payment processor's terms.

3.2 No Refunds Policy & EU Withdrawal Rights

Because our Service involves immediate allocation of storage and processing resources:

  • Standard Policy: You may request a full refund within 24 calendar hours of purchase, PROVIDED that no contributions (photos, memories, audio) have been added. Once ANY content is added, or after 24 hours, ALL SALES ARE FINAL.
  • EU Consumers (Right of Withdrawal): Under EU law (Article L.221-18 of the French Consumer Code), consumers typically have a 14-day right of withdrawal. HOWEVER, by upgrading your plan and beginning to create a Timeline (uploading content), you expressly request immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal (Article L.221-28, 13°). You will be asked to confirm this waiver at checkout.

3.3 Chargebacks

We reserve the right to suspend accounts and delete associated content for **unauthorized or fraudulent chargebacks**, after reasonable investigation. If you have a billing issue, please contact support@legacees.com first.

4. User Content & Rights

4.1 Your Rights & License Grant

  • Ownership: You and your contributors retain all ownership rights to the User Content you upload. We do NOT claim ownership of your personal memories.
  • License to Us: By uploading content, you grant Legacees a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, modify (for formatting purposes), and distribute your User Content solely for the purpose of operating and providing the Services to you (e.g., hosting the Timeline, creating downloadable PDF/HTML files).
  • Contributor Warranty: You warrant that you have obtained all necessary permissions and consents from any third parties (contributors) before inviting them to add content or uploading content on their behalf. You agree to be responsible for their compliance with these Terms.

4.2 Data Privacy (GDPR)

Your data rights are important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your data, as well as your rights to access, rectification, and deletion.

4.3 Prohibited Content

You agree not to upload or share content that:

  • Is illegal, violent, threatening, or promotes hate speech.
  • Infringes on the intellectual property or privacy rights of others.
  • Contains sexually explicit material, nudity, or pornography.
  • Depicts minors in an inappropriate, sexual, or exploitative manner.
  • Contains viruses, malware, or malicious code.

Violation of these restrictions will result in immediate account termination without refund.

5. Service Delivery & Availability

5.1 Hosting, Archival & Data Retention

  • Active Period: Timelines remain active and editable from creation until the "Reveal Date" plus 30 days.
  • Archival: After this period, Timelines will be archived (read-only). We do not guarantee indefinite hosting.
  • Deletion: We reserve the right to permanently delete archived Timelines after a period of inactivity (e.g., 12 months) or upon account termination. You are solely responsible for downloading your Timeline files (HTML/PDF) during the active period.

5.2 Uptime & Force Majeure

We rely on third-party providers and generally strive for high availability. However, we are not liable for interruptions caused by factors beyond our reasonable control (e.g., natural disasters, internet infrastructure failures, war, riots, strikes).

6. Limitation of Liability & Indemnification

  • AS-IS SERVICE: THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
  • CAP ON LIABILITY: CHAMBERLIN INNOVATIONS SASU'S TOTAL LIABILITY SHALL BE LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
  • Indemnification: You agree to indemnify and hold harmless Chamberlin Innovations SASU from any claims arising out of your User Content (e.g., copyright infringement) or your use of the Services in violation of these Terms.

8. Dispute Resolution

Governing Law: This Agreement shall be governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the courts of France.

Consumer Mediation: In accordance with the French Consumer Code, EU consumers may also have recourse to a consumer mediation service for amicable dispute resolution.

9. General Provisions

  • Changes: We may modify these Terms at any time. Continued use constitutes acceptance.
  • Termination: We may terminate your access if you violate these Terms. Upon termination, your right to use the Service will immediately cease.
